SERVICE AGREEMENT – BYRD’S NEST LAWNCARE
By scheduling or receiving services from Byrd’s Nest Lawncare (“Company,” “we,” or “us”), the customer (“Client” or “you”) acknowledges, accepts, and agrees to be bound by the following Terms of Service. These terms apply to all lawn care and related services unless otherwise agreed to in writing.
1. Recurring Service
All lawn care services are provided on a recurring basis unless expressly stated otherwise. While our scheduling software may include features such as appointment confirmations, Byrd’s Nest Lawncare does not require confirmations and will service your property according to your recurring service schedule.
We do not require long-term contracts, and you may cancel services at any time in accordance with the cancellation policy below.
2. Payment Terms
2.1 Payment Method Required
Clients must maintain a valid payment method on file at all times. Payments will be automatically processed upon completion of each service.
2.2 Failure of Payment
If your payment method becomes invalid, expired, or otherwise unusable, services may be suspended or terminated until payment information is updated and the account is brought current.
3. Cancellation & Skip Policy
3.1 Client-Initiated Skip
If you choose to skip or cancel a scheduled service for any reason, a $25 skip fee will be charged to your account. This fee covers lost scheduling capacity and route disruption.
3.2 Cancellation of Recurring Service
You may cancel ongoing service at any time. Cancellations must be made before the next scheduled service to avoid the skip fee described above.
4. Weather Delays & Rescheduling
In the case of inclement or unsafe weather, services may be delayed or rescheduled. We will make reasonable efforts to reschedule at the earliest available opportunity once weather permits.
Weather-related delays do not relieve Clients of the requirement to maintain an active payment method or exempt Clients from applicable skip fees if a service is intentionally canceled by the Client.
5. Property Access Requirements
Clients are responsible for ensuring that:
All gates are unlocked
Pets are secured
Any obstacles are removed prior to service
If our team cannot access the property due to locked gates, unsecured pets, or other obstructions, a $25 skip fee will be assessed.
6. Liability & Property Conditions
Byrd’s Nest Lawncare exercises reasonable care in delivering all services. However, we are not liable for damage to:
Underground utilities
Irrigation systems
Invisible or hidden hazards
Unmarked obstacles
Clients are responsible for marking or notifying us of any such items prior to service.
7. Acceptance of Terms
By scheduling services, receiving services, or keeping Byrd’s Nest Lawncare as your provider, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
